The licensing Simplex, which will come into force in March, is being called into question by the Order of Architects, which warned this Thursday, January 25, of the "mismatch" between the changes recommended by the regulator with regard to projects and other regimes that will remain in force until March 4. 

According to Alexandra Lourenço, an architect who supports the practice of the Northern Regional Section of the Order of Architects, she believes there is "an oversight" in the document, which concerns the time gap in the legislation that requires bidets in bathrooms, but which also determines the end of their obligation: "during this period [from January 1 to March 4] some reflection on the subject is necessary", she asks.

No corrections to the legislation in question have been published in the Diário da República. On the other hand, consideration should be given to repealing certain requirements in Decree-Law no. 10/2024 to the General Regulation on Urban Buildings (RGEU), including the obligation to have bidets in bathrooms and the possibility of having a shower tray instead of a bathtub. 

The accessibility regime lays down exactly what facilities must be taken into account in buildings and establishments that receive the public, on public roads or in residential buildings, in which it is possible to read that there must be "at least one sanitary installation [...] equipped with at least one washbasin, one bidet and one bathtub", determining that "alternatively, a shower tray may be installed (...) as long as the space for the possible installation of a bathtub is guaranteed". 

The repeal in question is retroactive to January 1 when the new simplex comes into force, however, the rules and techniques of the regime will remain in force until March 4. 

Alexandra Lourenço admits that "there may be conflicts" in these documents, so professionals should carefully consider the "new changes", stressing: "there is a clear intention that the bidet is no longer mandatory. That is the clear intention of the legislator, but there has been a lag in the repeal of the rules", calling for "caution" on the part of technicians.
